1. Acceptance of Terms
By accessing or using any services provided by Orca Stacks, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services.
2. Services Provided
Orca Stacks provides custom software development, IT consulting, web/mobile development, and related services. Scope of work is defined in individual project agreements.
3. Client Responsibilities
Clients must provide accurate project requirements, timely feedback, and necessary access/credentials to facilitate delivery.
4. Payment Terms
Payment schedules are outlined in individual contracts. Orca Stacks reserves the right to pause work on overdue invoices.
5. Intellectual Property
Upon full payment, clients receive full ownership of the delivered code and assets. Orca Stacks retains the right to display the project in its portfolio unless agreed otherwise.
6. Confidentiality
Both parties agree to keep each other's business information confidential during and after the engagement.
7. Limitation of Liability
Orca Stacks is not liable for indirect, incidental, or consequential damages arising from project delays due to client-side factors.
8. Termination
Either party may terminate the agreement with 14 days written notice. Completed milestones are billable upon termination.
9. Governing Law
These terms are governed by the laws of India. Disputes shall be resolved under the jurisdiction of courts in Jaipur, Rajasthan.
10. Changes to Terms
Orca Stacks reserves the right to update these terms. Clients will be notified of significant changes.
